Any estimate, quote, or pricing information provided by Montana Mobile Mix is based on the information available at the time it is given. Estimates may change if project details, access conditions, quantities, materials, scheduling, labor needs, travel distance, or other relevant factors change.

Unless specifically stated in writing, estimates are not a guarantee of final cost. Final charges may be based on the actual amount of concrete used, materials required, time on site, delivery requirements, additional services requested, or other applicable charges.

5. Scheduling and Availability

Scheduling is subject to availability and may be affected by weather, road conditions, equipment availability, supplier availability, staffing, traffic, jobsite readiness, or other circumstances outside of our control.

We will make reasonable efforts to arrive within the scheduled service window; however, we do not guarantee exact arrival times. Montana Mobile Mix is not responsible for delays caused by weather, road closures, unsafe access, incomplete site preparation, customer delays, third-party delays, or other conditions outside our reasonable control.

6. Customer Responsibilities

You are responsible for providing accurate project information before service is scheduled. This may include project location, access details, concrete quantity, desired mix requirements, placement needs, site conditions, and any special instructions.

You are also responsible for ensuring that the jobsite is safe, accessible, and ready for service upon our arrival. This includes, but is not limited to:

Providing safe and legal access for trucks and equipment
Confirming adequate space for service and maneuvering
Ensuring the site is properly prepared for concrete placement
Obtaining any necessary permits, approvals, inspections, or permissions
Marking or disclosing underground utilities, septic systems, irrigation lines, private roads, landscaping, soft ground, or other site hazards
Having adequate labor, tools, forms, reinforcement, and finishing crews ready if needed

Montana Mobile Mix may refuse or postpone service if the jobsite is unsafe, inaccessible, not ready, or unsuitable for service.

7. Concrete Placement and Project Conditions

Concrete performance can be affected by many factors, including site preparation, subgrade conditions, weather, temperature, water exposure, finishing practices, curing methods, reinforcement, drainage, and other factors outside of Montana Mobile Mix’s control.

Unless otherwise agreed in writing, Montana Mobile Mix is not responsible for site preparation, forming, reinforcement, finishing, curing, sealing, engineering, structural design, drainage, excavation, compaction, or final surface appearance.

You are responsible for determining whether the concrete mix, strength, slump, additives, placement method, and project specifications are suitable for your intended use. For structural, engineered, commercial, or code-regulated projects, you should consult with the appropriate licensed professional, contractor, engineer, inspector, or authority.

8. Changes, Cancellations, and Delays

If you need to change or cancel a scheduled service, please notify Montana Mobile Mix as soon as possible.

We reserve the right to charge cancellation fees, mobilization fees, wait-time fees, or other reasonable charges if a job is canceled late, delayed after arrival, inaccessible, unsafe, or not ready for service.

If weather or other conditions make service unsafe or impractical, Montana Mobile Mix may reschedule the service at our discretion.

9. Payment Terms

Payment terms will be provided at the time of estimate, scheduling, invoice, or written agreement. Payment is due according to the terms stated on the invoice or agreement.

Montana Mobile Mix reserves the right to require deposits, prepayment, payment upon delivery, or payment upon completion depending on the project, customer, or service type.

Late payments may be subject to late fees, interest, collection costs, attorney fees, or other remedies allowed by law. We reserve the right to suspend or refuse future service for unpaid balances.

10. Limited Warranty Disclaimer

Montana Mobile Mix will make reasonable efforts to provide services in a professional manner. However, except as expressly stated in writing, our website and services are provided “as is” and “as available.”

To the fullest extent permitted by law, Montana Mobile Mix disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, workmanship by third parties, suitability of materials for a specific application, or final project outcome.

Because concrete results may be affected by customer decisions, site conditions, weather, placement, finishing, curing, and other outside factors, Montana Mobile Mix does not guarantee against cracking, discoloration, scaling, surface imperfections, curing issues, settling, drainage issues, or other conditions outside of our direct control.

11. Limitation of Liability

To the fullest extent permitted by law, Montana Mobile Mix, LLC shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of our website, reliance on website content, or use of our services.

Our total liability for any claim related to services shall not exceed the amount paid to Montana Mobile Mix for the specific service giving rise to the claim, unless otherwise required by law.
